2. Service Description

DataHive provides a platform for extracting and analyzing publicly available data from Facebook. Our services include:

  • Usage analytics and billing

3. Educational Purpose & Third-Party Terms

IMPORTANT: DataHive is provided for educational and research purposes only.

You acknowledge and agree that:

  • You are responsible for compliance with Facebook's Terms of Service and all applicable laws
  • DataHive does not grant permission to violate third-party terms of service
  • You use this service at your own risk
  • You will use extracted data only for legitimate, legal, and ethical purposes
  • You will not use our service for commercial purposes that violate Facebook's policies

We strongly recommend reviewing Facebook's Terms of Service and Automated Data Collection Policy before using DataHive.

4. User Accounts

4.1 Registration

To use DataHive, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account
  • Not share your account with others

4.2 Eligibility

You must be at least 18 years old to use DataHive. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, suspected fraudulent activity, or misuse of the platform.

5. Subscription Plans and Billing

5.1 Pricing Plans

DataHive offers multiple pricing tiers:

  • Pay-As-You-Go: Per-request billing with no monthly commitment
  • Starter Plan: Monthly subscription with included request quota
  • Advanced Plan: Higher limits with priority support
  • Advanced+ Plan: Maximum limits with dedicated support

5.2 Payment Terms

By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your selected plan
  • Provide valid payment information
  • Authorize automatic recurring billing for subscription plans
  • Pay for usage beyond your plan limits at standard rates

5.3 Billing Cycle

Subscription plans are billed monthly in advance. Pay-as-you-go usage is charged as incurred. You can view your current usage and billing information in your account dashboard.

5.4 Refund Policy

Subscription fees are generally non-refundable. If you cancel your subscription mid-cycle, you will retain access until the end of your billing period. Refunds may be issued at our sole discretion for service outages or technical issues.

5.5 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of your next billing cycle.

6. Acceptable Use Policy

You may NOT use DataHive to:

  • Attempt to circumvent platform security measures
  • Resell or redistribute our services without permission
  • Overload or disrupt our infrastructure

7. API Usage

7.1 API Keys

You are responsible for maintaining the confidentiality of your API keys. Do not share them publicly or expose them in client-side code.

7.2 Rate Limits

7.3 API Changes

We may modify our API at any time. We will provide reasonable notice of breaking changes, but cannot guarantee backwards compatibility indefinitely.

8. Data Ownership and Rights

You retain ownership of data you extract through DataHive. However, you acknowledge that this data originates from third-party sources and may be subject to their terms and rights.

8.2 Our Rights

We retain ownership of the DataHive platform, code, and infrastructure. You may not reverse engineer, decompile, or attempt to extract our source code.

8.3 Usage Statistics

We may collect and use anonymized usage statistics to improve our services, as outlined in our Privacy Policy.

9. Disclaimer of Warranties

DATAHIVE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that:

  • The service will be uninterrupted or error-free
  • Data extracted will be accurate, complete, or up-to-date
  • The service will meet your specific requirements
  • Security measures will prevent unauthorized access
  • Third-party platforms will remain accessible

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

DataHive and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Service interruptions or data breaches
  • Actions taken by third parties (including Facebook)
  • Inaccuracy or incompleteness of extracted data
  • Your use or misuse of the service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless DataHive, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of third-party rights or terms
  • Your use of extracted data

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the platform. Your continued use after changes constitutes acceptance of the updated Terms.

13. Termination

Either party may terminate this agreement at any time:

  • You: By deleting your account through account settings
  • We: By providing notice for violations or at our discretion

Upon termination, your access will cease, but certain provisions (including payment obligations and liability limitations) will survive.

14. Governing Law and Disputes

These Terms are governed by applicable laws. Any disputes shall be resolved through:

  • Binding arbitration if negotiations fail
  • Individual basis only (no class actions)

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and DataHive.

15.2 Severability

If any provision is found unenforceable, the remaining provisions shall remain in effect.

15.3 No Waiver

Our failure to enforce any right does not waive that right.
